Club Management Waiver, Release of Liability, and Assumption of Risk

By accessing, participating in, organizing, attending, or using any services, facilities, events, leagues, tournaments, programs, software, applications, or activities operated, managed, or facilitated by [Club Name] (“Club”), I acknowledge and agree to the following terms:

1. Assumption of Risk

I understand that participation in sports, fitness, recreational, social, and related activities — including but not limited to pickleball, training sessions, leagues, tournaments, clinics, open play, and other events — involves inherent risks of injury, illness, property damage, permanent disability, or death.

I voluntarily assume all risks associated with participation, including but not limited to:

Slips, falls, and collisions
Equipment failure or misuse
Acts or omissions of participants, spectators, staff, or third parties
Exposure to communicable illnesses
Weather-related or facility-related hazards

I acknowledge that these risks may arise from negligence or other causes.

2. Release and Waiver of Liability

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue the Club, its owners, directors, officers, employees, contractors, volunteers, sponsors, affiliates, partners, venue operators, and agents from any and all liability, claims, demands, damages, losses, or causes of action arising out of or related to:

Participation in Club activities
Attendance at Club facilities or events
Use of Club equipment or services
Personal injury, illness, death, or property damage

This release applies whether caused by negligence or otherwise, except where prohibited by applicable law.

3. Medical Treatment Authorization

I authorize the Club and its representatives to obtain emergency medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical costs incurred.

4. Participant Responsibility

I agree to:

Follow all Club rules, policies, and staff instructions
Use facilities and equipment responsibly
Participate only if physically able and medically fit
Conduct myself in a respectful and sportsmanlike manner

The Club reserves the right to remove or suspend any participant for unsafe, disruptive, abusive, or inappropriate conduct.

5. Photo & Media Release

I grant the Club permission to photograph, record, and use my name, image, likeness, voice, and participation in promotional, marketing, social media, broadcast, and commercial materials without compensation or approval rights.

6. Technology & Platform Usage

If participating through the Club’s website, mobile application, or management platform, I acknowledge that:

My account and participation data may be stored electronically
I am responsible for maintaining the confidentiality of my login credentials
The Club is not liable for temporary outages, technical issues, or unauthorized access beyond reasonable security measures

7. Indemnification

I agree to indemnify and hold harmless the Club from any claims, damages, liabilities, costs, or expenses arising from:

My participation
My conduct
My violation of Club rules or applicable laws
Claims brought on behalf of minors under my supervision

8. Minors

If signing on behalf of a minor participant, I certify that I am the parent or legal guardian and agree to all terms on behalf of the minor.

9. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of [State], without regard to conflict of law principles.

10. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Acknowledgment

I acknowledge that:

I have carefully read and fully understand this Agreement
I understand that I am giving up substantial legal rights
I voluntarily agree to these terms
